Recent changes (October 2026): We added Section 17, which explains how our new AI Writer handles information. We also named the providers who help run our websites (Section 8) and added PostHog to Section 11. None of these changes affects how we use information you have already given us.

1. Introduction

We collect personal information directly from you, from third parties, and automatically when you use our services. This includes:

  • Interaction Records: Communication logs, service usage data
  • Technical Data: IP address, device identifiers, browser type, pages visited, and analytics logs
  • User-Generated Content: Photos, videos, obituary text, or other materials uploaded
  • AI Writer Content: Details you enter into our AI Writer about a person who has died and about their family (see Section 17)

We do not sell or rent personal data to third-party advertisers.

3. Legal Basis for Processing

We process personal data under the following legal grounds:

  • Consent: When you give us permission to collect and use your data.
  • Legitimate Interests: To improve our services, analyze usage, and maintain security.
  • Legal Compliance: When required by law or legal process.

4. How We Collect Data

We collect data through:

  • Direct interactions (e.g., sign-ups, customer inquiries, memorial creation)
  • Automated technologies (e.g., cookies, tracking pixels)
  • Third-party sources (e.g., service providers, partners)

5. Data Retention

  • We retain personal data for 90 days after the last account activity unless retention is required by law.
  • Users may request extended data retention for memorial content.
  • Inactive content may be removed after 90 days, with notice provided before deletion.

6. Security Measures

We implement industry-standard security protocols, including:

  • AES-256 encryption (for stored data)
  • SSL/TLS encryption (for data in transit)
  • Restricted access to personal data (only authorized personnel)
  • Breach notification: Users will be informed of security breaches within 72 hours.

7. How We Use Your Data

We do not use personal data for third-party advertising.

Our service providers are contractually required to protect your data and may use it only to provide their services to us, except for limited uses their terms allow (e.g., security, fraud prevention, safety review, and legal compliance). Our analytics providers also handle data under their own privacy terms (see Section 11).

9. International Data Transfers

Your personal information may be transferred to and processed in the United States and Australia.

Where required, we use Standard Contractual Clauses (SCCs) or other safeguards to ensure compliance with EU, UK, and Canadian privacy laws.

13. Children’s Privacy

  • Our services are not intended for individuals under 18.
  • We do not knowingly collect personal data from children under 13.
  • If we discover a child’s data was collected, we will delete it immediately.

  • We notify users via email and a prominent website notice at least 30 days before major changes.
  • Continued use of our services after changes indicates acceptance.

17. AI Writer

What you type into the AI Writer is sent to our AI provider, Anthropic, to write your draft. We do not keep a copy. Your own saved copy of your answers and drafts stays in the web browser on your device; Anthropic keeps what it processes for a limited time, as explained below.

Our free AI writing tool at writer.eulogizememorials.com (the "AI Writer") helps you write a first draft of an obituary, eulogy, or death notice. This Section 17 explains how the AI Writer handles information. The rest of this Privacy Policy also applies, but if anything in this Section 17 differs from the rest of this Privacy Policy, this Section 17 applies to the AI Writer.

What You Share

  • To write a draft, the AI Writer asks about the person who has died (e.g., their name, dates, places, family, work, personality, beliefs, and service details).
  • You may also share your relationship to them and details about other people, such as surviving family.
  • Some details may be sensitive (e.g., a cause of death or health information). Please share only what you are comfortable having in a draft.
  • We use what you share to write and check your draft and to keep the AI Writer safe and working well, and for nothing else.
  • We never use it for advertising.

Bringing In an Obituary You Already Have

  • If you paste a link to an obituary that is already online, our servers fetch that public page, take the obituary text and any name, dates, and service details the page states, and place them in your story for you to read over.
  • We do not keep the link or the page. Our analytics record whether the page could be read and a few counts about it (which part of the page the text came from, how many details were found, and its approximate length), never the link, the website, or its text.
  • The text is then handled like anything else you enter, as described below.

How Your Draft Is Written

  • When you submit your story or ask for a draft, what you entered is sent from our servers to Anthropic, the company that makes the Claude AI models.
  • Anthropic processes it on our behalf to read your story, write your draft, and check the draft against what you shared, then returns the result to you. Anthropic may process it in the United States or other countries where it operates.
  • Under its commercial terms, Anthropic may not use it to train its AI models.
  • Anthropic's published policy is to delete it within 30 days, unless its safety systems flag it (in which case it may be kept for up to two years) or the law requires otherwise.

What We Keep

  • We do not keep a copy of the details you enter or of your drafts, and they are not written to our application logs.
  • Your answers and drafts are saved in the web browser on your device so you can come back to them. They stay there until you select "Start over" or clear your browser data. Anyone who uses the same browser on your device can see them.
  • They will not follow you to another device or browser, so download your draft to keep it. Downloads (PDF, Word, or text) are created on your device.
  • If you are using a shared or public device, select "Start over" when you are finished.
  • The usage records described below are kept by our analytics providers. They never contain what you write or your draft.

Voice Dictation

  • If you choose to dictate, your browser's built-in speech recognition turns your speech into text.
  • Depending on your browser, your audio may be sent to the company that makes it (e.g., Google, if you use Chrome) to do this, under that company's privacy terms.
  • We do not receive or store your audio.

Technical and Usage Information

  • Our hosting provider, Vercel, processes your request, including your IP address, to deliver the AI Writer, block misuse, and limit how often it can be used. Vercel may process your request in the United States or other countries where it operates.
  • We use PostHog and Google Analytics to understand how the AI Writer is used (e.g., how many people visit, which steps they complete, whether a draft is created or downloaded, and whether an obituary link could be read).
  • Like most website analytics, these tools receive technical information such as your IP address and device type, and store an identifier in your browser. If you are signed in to a Eulogize account in the same browser, these usage records may be connected to that account.
  • When we record events on our servers, we replace your IP address with a coded identifier. We also include broad categories our system notices in what you write (e.g., that a death was sudden or involved a child), so we can check that the AI Writer handles them with care.
  • Our analytics never receive the words you write or your draft.

If You May Need Support

  • You may write about how someone died, including by suicide or overdose.
  • If what you write suggests that you may be at risk right now, the AI Writer pauses to show support resources, and you can choose to carry on.
  • We record that this happened, but not what you wrote.

No Account Needed

  • You do not need an account to use the AI Writer.
  • We do not use what you share to make decisions about you.

Your Choices

  • We cannot see or recover what you have written, so we cannot delete or restore it for you. Selecting "Start over" clears it from your device.
  • For other information we hold (e.g., usage records), your rights in Section 12 apply.
